\nSe eu fosse um homem, meus senhores, que n\u00e3o considerasse um juramento, eu n\u00e3o precisaria, como \u00e9 sabido, neste lugar, neste momento, nem neste caso, ficar como uma pessoa acusada. E se este seu juramento, Mestre Rich, for verdadeiro, ent\u00e3o eu rogo para que eu nunca possa ver Deus face-a-face, o que eu n\u00e3o diria se fosse, de outra forma, para ganhar o mundo inteiro.
\nDe boa f\u00e9, Mestre Rich, eu estou mais triste por seu perj\u00fario do que pelo meu pr\u00f3prio perigo, e voc\u00ea deve entender que nem eu nem homem algum que eu saiba jamais te considerou ser um homem de tal cr\u00e9dito em qualquer assunto de import\u00e2ncia para que eu ou qualquer outro em qualquer tempo nos permit\u00edssemos comunicar com voc\u00ea. E eu, como voc\u00ea sabe, nem por um momento quis saber de voc\u00ea e de sua conversa, eu que o conhe\u00e7o desde a sua mocidade at\u00e9 agora, pois residimos por muito tempo numa par\u00f3quia. Onde quer que voc\u00ea tenha estado (eu sinto muito por voc\u00ea me obrigar a dizer) voc\u00ea foi estimado como algu\u00e9m de l\u00edngua muito leve, um grande trapaceiro, e sem fama louv\u00e1vel. E assim em sua casa no Templo, onde tem sido o seu principal crescimento, voc\u00ea assim foi tachado. Pode, portanto, parecer prov\u00e1vel \u00e0s vossas honrosas senhorias, que eu, numa causa t\u00e3o importante, cairia t\u00e3o imprudentemente no erro de confiar no Mestre Rich, um homem a mim sempre reputado como de pouca verdade como vossas senhorias t\u00eam ouvido, muito acima do meu senhor soberano rei, ou de qualquer de seus nobres conselheiros, a ponto de dizer-lhe os segredos da minha consci\u00eancia sobre a supremacia do rei, o ponto especial e \u00fanico selo das minhas m\u00e3os h\u00e1 tanto tempo procurado?
\nUma coisa que eu nunca fiz, nem nunca faria, diante do estatuto aqui feito, \u00e9 revelar \u00e0 pr\u00f3pria Alteza Real ou a qualquer de seus honor\u00e1veis conselheiros, como n\u00e3o \u00e9 desconhecido por suas honras, em distintos e v\u00e1rios tempos, por meio de uma pessoa enviada pelo pr\u00f3prio Rei at\u00e9 a Torre e a mim para nenhum outro prop\u00f3sito. Pode isso em seu julgamento, meus senhores, parecer provavelmente ser verdade? E se eu tivesse feito assim, de fato, meus senhores, como Mestre Rich jurou, vendo que era algo falado numa conversa familiar secreta, nada afirmando e apenas colocando casos, sem outras circunst\u00e2ncias desagrad\u00e1veis, isso n\u00e3o pode justamente ser tomado como algo falado maliciosamente; e onde n\u00e3o h\u00e1 mal\u00edcia, n\u00e3o pode haver ofensa. E sobre isso eu nunca posso imaginar, meus senhores, que tantos bispos dignos, tantos personagens nobres, e muitos outros homens dignos de adora\u00e7\u00e3o, virtuosos, s\u00e1bios e bem instru\u00eddos como os que foram reunidos em Parlamento para fazer a lei, que eles um dia pensassem em punir com a morte qualquer homem em quem n\u00e3o pudesse ser encontrada nenhuma mal\u00edcia, tomando malitia pro malevolentia : pois se mal\u00edcia for geralmente tida como pecado, n\u00e3o h\u00e1 homem aqui que possa se escusar. Quia si dixerimus quod peccatum non habemus, nosmetipsos seducimus, et veritas in nobis non est . E s\u00f3 esta palavra, “maliciosamente” \u00e9 material no estatuto, como este termo “\u00e0 for\u00e7a” est\u00e1 no estatuto de termos for\u00e7ados, por cujo estatuto se um homem entrar pacificamente e n\u00e3o tirar seu advers\u00e1rio “\u00e0 for\u00e7a” n\u00e3o h\u00e1 nenhuma ofensa, mas se ele tir\u00e1-lo “\u00e0 for\u00e7a” ent\u00e3o por este estatuto isso \u00e9 uma ofensa, e assim deve ser punido por este termo, “\u00e0 for\u00e7a”.
\nAl\u00e9m disso, a bondade multiforme da pr\u00f3pria Alteza do Rei, que tem sido em tantas maneiras meu bom e singular senhor e gracioso soberano, e que tem tanto me amado e em mim confiado, mesmo na minha primeira vinda a seu nobre servi\u00e7o, com a dignidade do honor\u00e1vel conselho privado, se condescendendo a admitir-me; e, finalmente, com o pesado fardo de ser o mais alto chanceler de Sua Gra\u00e7a, algo que ele n\u00e3o fez a nenhum homem temporal antes, pr\u00f3ximo \u00e0 sua pessoa real no mais alto cargo deste reino inteiro, muito acima minhas qualidades ou m\u00e9ritos e concordou por sua pr\u00f3pria benignidade incompar\u00e1vel em me honrar e exaltar, pelo espa\u00e7o de 20 anos ou mais, mostrando seus favores cont\u00ednuos em rela\u00e7\u00e3o a mim, e (at\u00e9 que, pelo meu pr\u00f3prio e pobre pedido, aprouve a Sua Alteza dar-me licen\u00e7a com o favor de Sua Majestade para desfrutar o resto da minha vida totalmente para alimentar a minha alma \u00e0 servi\u00e7o de Deus, e, pela sua bondade especial, para descarregar e aliviar-me) da forma mais benigna abundou-me de honras continuamente mais e mais; devo dizer que tudo isso que a bondade de Sua Alteza estendeu para mim com tamanha generosidade e por tanto tempo estava em minha mente, meus senhores, o que \u00e9 suficiente para mostrar o erro dessa conjectura caluniosa, feita por este homem, t\u00e3o erroneamente imaginada contra mim….
\nVejo, meu senhor, que esta acusa\u00e7\u00e3o \u00e9 baseada num ato do Parlamento diretamente antag\u00f4nico \u00e0s leis de Deus e de sua santa Igreja, cujo governo supremo, seja do todo seja de alguma das partes, nenhum pr\u00edncipe temporal pode presumir em tomar para si por nenhuma lei, por pertencer legitimamente \u00e0 S\u00e9 de Roma, uma preemin\u00eancia espiritual vinda da boca de nosso pr\u00f3prio Salvador, pessoalmente presente na Terra, e dada a S\u00e3o Pedro e seus sucessores, bispos da mesma s\u00e9, por prerrogativa especial concedida; ela est\u00e1, portanto, pela lei entre homens Crist\u00e3os, e \u00e9 insuficiente para acusar qualquer homem Crist\u00e3o ….
\nMais eu n\u00e3o tenho a dizer, meus senhores, al\u00e9m daquilo como o bendito ap\u00f3stolo S\u00e3o Paulo, segundo lemos nos Atos dos Ap\u00f3stolos, estava presente e concordou com a morte de Santo Estev\u00e3o, e manteve as roupas dos que o apedrejaram at\u00e9 a morte, e ainda assim eles s\u00e3o agora dois santos sagrados no c\u00e9u, e l\u00e1 devem continuar amigos para sempre: assim eu confio verdadeiramente e devo, portanto, corretamente orar de cora\u00e7\u00e3o para que, apesar de vossas senhorias j\u00e1 na terra terem sido os ju\u00edzes da minha condena\u00e7\u00e3o, n\u00f3s ainda possamos no c\u00e9u alegremente todos juntos nos reunir para a nossa salva\u00e7\u00e3o eterna.

\nIf I were a man, my lords, that did not regard an oath, I need not, as it is well known, in this place, at this time, nor in this case to stand as an accused person. And if this oath of yours, Master Rich, be true, then pray I that I may never see God in the face, which I would not say, were it otherwise to win the whole world.
\nIn good faith, Master Rich, I am sorrier for your perjury than for mine own peril, and you shall understand that neither I nor any man else to my knowledge ever took you to be a man of such credit in any matter of importance I or any other would at any time vouchsafe to communicate with you. And I, as you know, of no small while have been acquainted with you and your conversation, who have known you from your youth hitherto, for we long dwelled together in one parish. Whereas yourself can tell (I am sorry you compel me to say) you were esteemed very light of tongue, a great dicer, and of no commendable fame. And so in your house at the Temple, where hath been your chief bringing up, were you likewise accounted. Can it therefore seem likely to your honorable lordships, that I would, in so weighty a cause, so unadvisedly overshoot myself as to trust Master Rich, a man of me always reputed for one of little truth, as your lordships have heard, so far above my sovereign lord the king, or any of his noble counselors, that I would unto him utter the secrets of my conscience touching the king’s supremacy, the special point and only mark at my hands so long sought for?
\nA thing which I never did, nor ever would, after the statute thereof made, reveal unto the King’s Highness himself or to any of his honorable counselors, as it is not unknown to your honors, at sundry and several times, sent from His Grace’s own person unto the Tower unto me for none other purpose. Can this in your judgment, my lords, seem likely to be true? And if I had so done, indeed, my lords, as Master Rich hath sworn, seeing it was spoken but in familiar, secret talk, nothing affirming, and only in putting of cases, without other displeasant circumstances, it cannot justly be taken to be spoken maliciously; and where there is no malice there can be no offense. And over this I can never think, my lords, that so many worthy bishops, so many noble personages, and many other worshipful, virtuous, wise, and well-learned men as at the making of the law were in Parliament assembled, ever meant to have any man punished by death in whom there could be found no malice, taking malitia pro malevolentia: for if malitia be generally taken for sin, no man is there that can excuse himself. Quia si dixerimus quod peccatum non habemus, nosmetipsos seducimus, et veritas in nobis non est. [If we say we have no sin, we deceive ourselves and the truth is not in us.] And only this word, “maliciously” is in the statute material, as this term “forcibly” is in the statute of forcible entries, by which statute if a man enter peaceably, and put not his adversary out “forcibly,” it is no offense, but if he put him out “forcibly,” then by that statute it is an offense, and so shall be punished by this term, “forcibly.”
\nBesides this, the manifold goodness of the King’s Highness himself, that hath been so many ways my singular good lord and gracious sovereign, and that hath so dearly loved and trusted me, even at my first coming into his noble service, with the dignity of his honorable privy council, vouchsafing to admit me; and finally with the weighty room of His Grace’s higher chancellor, the like whereof he never did to temporal man before, next to his own royal person the highest office in this whole realm, so far above my qualities or merits and meet therefor of his own incomparable benignity honored and exalted me, by the space of twenty years or more, showing his continual favors towards me, and (until, at mine own poor suit it pleased His Highness, giving me license with His Majesty’s favor to bestow the residue of my life wholly for the provision of my soul in the service of God, and of his special goodness thereof to discharge and unburden me) most benignly heaped honors continually more and more upon me; all this His Highness’s goodness, I say, so long thus bountifully extended towards me, were in my mind, my lords, matter sufficient to convince this slanderous surmise by this man so wrongfully imagined against me….
\nForasmuch, my lord, as this indictment is grounded upon an act of Parliament directly oppugnant to the laws of God and his holy church, the supreme government of which, or of any part thereof, may no temporal prince presume by any law to take upon him, as rightfully belonging to the See of Rome, a spiritual preeminence by the mouth of our Savior himself, personally present upon the earth, to Saint Peter and his successors, bishops of the same see, by special prerogative granted; it is therefore in law amongst Christian men, insufficient to charge any Christian man….
\nMore have I not to say, my lords, but that like as the blessed apostle Saint Paul, as we read in the Acts of the Apostles, was present and consented to the death of Saint Stephen, and kept their clothes that stoned him to death, and yet be they now twain holy saints in heaven, and shall continue there friends forever: so I verily trust and shall therefore right heartily pray, that though your lordships have now in earth been judges to my condemnation, we may yet hereafter in heaven merrily all meet together to our everlasting salvation.<\/p>\n","protected":false},"excerpt":{"rendered":"
